The Mexican Chamber of Deputies has approved a bill aimed at guaranteeing the right to health by prohibiting the commercialization of electronic cigarettes and vapes. The measure passed with 292 votes in favor, 163 against, and zero abstentions. During the session, a single reservation presented by Morena coordinator Ricardo Monreal was accepted to modify specific articles of the General Health Law.
The amendments redefine electronic inhalation devices to clarify they operate with liquid substances, eliminating ambiguous terms like "other than tobacco" to prevent commercial loopholes. Crucially, the bill establishes a strict prohibition on the marketing of all e-cigarettes and vapes, including disposable devices, which are identified as a primary access point for minors.
However, the legislation explicitly permits personal consumption and possession to avoid criminalizing users. "If a person is consuming or even has in their possession one or two electronic cigarettes, it is not a crime and they will not be sanctioned," Monreal stated. The proposal aligns with Article 4 of the Constitution, mandating the State to prevent activities related to these devices. Additionally, the bill strengthens the powers of the Federal Commission for Protection against Sanitary Risks (Cofepris) and introduces new rules for digital health and medical infrastructure.
