New, comprehensive regulations governing a wide range of vaping and alternative nicotine products are now in effect in Panama as of Wednesday, August 13th. The Ministry of Health (MINSA) announced the implementation of Resolution 146 of January 31, 2025, which establishes strict rules for the use, sale, and promotion of electronic nicotine delivery systems (ENDS), heated tobacco products (HTPs), and oral nicotine products (ONPs).
The regulation aims to protect public health, with a strong emphasis on safeguarding children and adolescents from the documented risks of these devices. Under the new rules, vaping is now **prohibited in all places where traditional smoking is already banned**. This includes enclosed public and private spaces such as offices, schools, hospitals, public transportation, restaurants, and shopping malls.
The law also introduces strict retail controls:
- Behind-the-Counter Sales: All regulated products must be kept out of direct public reach and view, stored in closed display cases rather than on open counters.
- Total Advertising Ban: Any form of direct or indirect advertising or promotion of these products is now forbidden, including on packaging and across all media platforms.
- Prohibition on Sales to Minors: Retailers must post visible signs indicating the ban on sales to minors and are required to verify the age of all purchasers using valid official identification.
This move follows a global survey released by MINSA in May, which revealed a 2% increase in e-cigarette use among Panamanian adolescents aged 13 to 15. MINSA warned that health and customs authorities will be actively monitoring compliance, with potential sanctions including confiscations, closures, and fines.
