    Pennsylvania Enforces Mandatory Vape Certification and Directory Under Act 57

    To combat unregulated nicotine products, the Pennsylvania Attorney General has launched a strict new vape directory requiring costly manufacturer certifications.

    Under the newly enacted Act 57 of 2025, the Pennsylvania Attorney General now requires all vape and e-cigarette manufacturers to be officially certified. The law establishes the "Pennsylvania Vape Directory" to ensure only FDA-approved or pending nicotine products are sold, backed by stringent enforcement capabilities and high certification fees.

    The new legislation imposes strict financial requirements on manufacturers to maintain their legal status within the state. The fee structure is outlined below:

    Regulatory Crackdown on Unlisted Products

    Act 57 of 2025 grants Attorney General Dave Sunday significant new enforcement tools, including the authority to seize unlisted products and recover costs from illegal actors. The public directory will list all compliant manufacturers, brand names, and flavors, directly impacting the state's 11,090 Other Tobacco Products licensees.

    The law ensures that only e-cigarettes with FDA approval or pending premarket review can be legally sold. Furthermore, it closes a common branding loophole by requiring zero-nicotine vapes to be certified if they share a brand name with a nicotine-containing product.

    A High Barrier to Entry

    Pennsylvania is aggressively tightening its regulatory grip. By imposing significant financial barriers and aligning state sales strictly with FDA compliance, Act 57 effectively chokes off the supply of cheap, unregulated illicit vapes. Manufacturers must now weigh the high cost of compliance against the severe penalties of operating outside the new directory.
