The Department of Health and Social Care has launched a UK-wide consultation on plans to introduce plain packaging and restrict flavor descriptions for vapes. This initiative, part of the Tobacco and Vapes Act, aims to make e-cigarettes less appealing to children. However, industry leaders warn that these measures will have unintended consequences for adult smokers.
Chris Kelly, founder of Phoenix 2 Retail—which distributes over 50 million vapes annually to major retailers like Tesco and Morrisons—described the proposed display and packaging limits as "disproportionate." While Kelly supports protecting youth, he argues that the current proposals treat vapes with the same regulatory severity as combustible tobacco.
"By treating vapes and pouches with the same regulatory approach as we do tobacco products, we are losing sight of the notion that they are a less harmful alternative to smoking," Kelly stated. He warned that moving e-cigarettes into closed cabinets or behind counters removes them from the line of sight of smokers, making them less likely to attempt the switch from cigarettes.
The vaping sector is already navigating a period of rapid regulatory transition. Over the last 12 to 18 months, businesses across the supply chain have had to absorb the operational impacts of the upcoming disposable vape ban and the introduction of a new vape duty. Kelly urged the government to allow the industry time to adjust to these existing policies before layering on additional restrictions.
As the consultation progresses, industry stakeholders are calling on policymakers to base decisions on evidence rather than public misinformation, ensuring that the voices of compliant retailers and adult switchers are represented in the final policy.
