Pennsylvania Attorney General Dave Sunday confirmed that state authorities will begin targeted enforcement of Act 57 on Oct. 19. The law prohibits gas stations, convenience stores, and vape shops from selling any electronic cigarettes, disposable vaporizers, or e-liquids that do not appear on a state-managed registry.
Passed with bipartisan legislative support, Act 57 restricts market access to products authorized by the FDA or tied to applications actively under federal review. Currently, the attorney general's directory lists 159 products from six manufacturers: Blue Nine, Custom Technologies, Juul Labs, NJOY, R.J. Reynolds Vapor Company, and The Schwartz E-Liquid.
"This law is about keeping harmful products out of the hands of both children and adults who may not realize what they are consuming," Sunday stated, pointing to youth-targeted flavors and unauthorized foreign imports.
Penalties and Retailer Obligations
Retailers must pull all unlisted inventory from store shelves before enforcement begins. The law establishes a tiered penalty system for businesses found selling off-directory products.

Manufacturers conducting unauthorized business in the state face separate $1,000 fines per product. Individual consumers who purchase or possess unlisted devices will not face fines unless they attempt to resell them.
Retailers Face Severe Inventory Losses
The rapid transition leaves many specialty vape shops facing substantial inventory losses. Store managers report that the vast majority of consumer-demanded hardware and flavored juices do not qualify under the initial six-brand registry.
James Wyckoff, manager of Mountain Vaporz, noted that unapproved items represent nearly 70% of his retail revenue. "Nothing that’s been approved, we carry," Wyckoff said. "That case, these two walls, all have to be bare."
The attorney general’s office confirmed it will update the state directory on a monthly basis as additional manufacturer applications complete review.
