New York State Assemblywoman Amy Paulin (D-88) has introduced Bill A11509, aiming to implement a generational tobacco ban. This legislative push comes amid a rising global movement to phase out tobacco access entirely for future generations, regardless of when they reach adulthood.
Under the proposed legislation, the sale of tobacco and vapor products would be banned for anyone born after December 31, 2007. This means that as the designated population ages, the legal purchase age will rise indefinitely, eventually phasing out legal tobacco sales entirely over time.
While New York is the latest state to consider the policy, generational bans have seen a mix of international momentum and domestic hurdles:
- International: The United Kingdom passed a ban in April 2024 for those born in or after 2008, while the Maldives implemented a ban in late 2025. Conversely, New Zealand passed a pioneering ban but repealed it in 2024.
- U.S. States: Similar proposals in Indiana and Hawaii died in legislative committees in early 2025.
- Local Towns: In March 2024, the Massachusetts Supreme Judicial Court upheld a local ban in Brookline, prompting other municipalities like Newton and South Hadley to pass matching local laws.
The bill faces strong opposition from industry groups. The Premium Cigar Association has launched a campaign urging voters to oppose A11509, arguing that this form of prohibition is a "one-size-fits-all" approach that unfairly targets adult consumers of handcrafted premium products.
