Act 57 of 2025 is now in effect, requiring all manufacturers of nicotine-containing e-cigarettes sold in Pennsylvania to obtain official certification from the state's Attorney General’s office.
- Public Directory: A comprehensive list of certified, compliant manufacturers will be published online by June 20.
- Strict Enforcement: The AG's office gains new powers to seize unlisted products and penalize illegal operators.
- Market Scope: The regulation impacts the approximately 11,090 "Other Tobacco Products" currently licensed in the state.
The Pennsylvania Attorney General’s office has confirmed that Act 57 of 2025 is now actively enforced, requiring all vape and e-cigarette manufacturers to be officially certified to sell nicotine products in the state. This legislative move aims to protect consumers from unregulated products, directly resulting in the creation of a mandatory public directory by June 20.
To secure a spot on the upcoming directory, manufacturers must prove their e-cigarettes either hold FDA approval or meet specific alternative state requirements. Attorney General Dave Sunday praised the legislation for providing critical mechanisms to keep illicit products out of Pennsylvania.
Under the new law, the Attorney General's office is equipped with enhanced enforcement capabilities, including:
- Imposing significant financial penalties on violators.
- Seizing unlisted and unregulated vape products.
- Recovering enforcement costs directly from illegal actors.
Manufacturers must apply using the official certification forms provided by the AG's office, with officials noting they should not use the standard cigarette application link. Any inquiries regarding the new compliance standards can be directed to [email protected].
