Manila Representative Rolando Valeriano has called on law enforcement agencies to prioritize the prosecution and conviction of illicit tobacco smugglers over mere product confiscation. This shift comes as the Philippines grapples with a black market that has drained \$2.5 billion in government revenues over the last two years.
Speaking at the Third International Tobacco Summit, Valeriano, who chairs the House committee on public order and safety, argued that publicizing warehouse raids and product seizures is no longer enough to deter organized crime. "If no one is convicted, no one is afraid and illicit trade will never stop," Valeriano warned, emphasizing the need to make illegal trade financially unsustainable.
The scale of the black market remains a major challenge. Data from the EU-ASEAN Business Council and Euromonitor International reveals that 25% of all cigarettes and more than 80% of all vapes sold in the Philippines are contraband, counterfeit, or unbranded.
To address this, Congress is considering an Anti-Illicit Trade measure. This proposed law would establish track-and-trace systems to monitor supply chains and improve coordination between enforcement agencies.
However, securing legal victories remains a hurdle. Prosecutor General Richard Anthony Fadullon revealed that the National Prosecution Service has filed 45 criminal complaints involving 164 individuals under the Anti-Agricultural Economic Sabotage Act.
Of those cases, only 10 have progressed to indictments in the Court of Tax Appeals. The remaining 75% of complaints were sent back to law enforcement agencies because of insufficient evidence, highlighting a gap in case preparation that prevents successful prosecution.
